It is the legal framework (Act 38/1999 of 5 November on the Regulation of Building), governing the building sector since it came into force or after its publication. This act, which has nationwide scope, regulates all new building works and existing buildings. Since it came into force, a building licence for the above projects must be applied for.

All buildings to be used as housing and to which the act is applicable, are obligued to take out a ten-year insurance policy which covers any material damages that originate from or affect the mechanical resistance or the stability of the building´s structure.

It is a surety insurance policy which lasts for ten years as from the initial date of coverage, which coincides with the date the works are delivered. This insurance covers the compensation or repair of the material damages contemplated in the legislation.
